These Terms & Conditions govern access to and use of Zobooq (hereinafter, "the Service"). By creating an account or using the Service you accept these terms. If you do not agree, do not use the Service.

2. Description of the Service
Zobooq is a software-as-a-service (SaaS) tool for managing tourist accommodation. Among other functions, it allows you to create the accommodation's website and its booking engine, manage bookings and availability, connect with channels and booking portals (OTAs), centralize communications with guests, manage payments and facilitate compliance with obligations such as traveler registration.
3. Plans, prices and billing
Zobooq is offered through subscription plans. The current prices and what each plan includes are shown on the pricing page; unless otherwise indicated they are stated exclusive of VAT, which will be added where applicable. The paid subscription is billed in advance and renews automatically for equal periods until you cancel it from your account; cancellation takes effect at the end of the current period. Payment is processed through our payment provider; by subscribing you accept its terms and we do not store your card details. If a charge is declined, we may retry it and suspend access to the paid features until the amount is settled. We may change prices by giving reasonable advance notice; the new prices will apply at the next renewal. Unless the law requires otherwise, amounts paid for periods already started are non-refundable.
4. Registration, account and capacity
To use the Service you must be of legal age and have the legal capacity to contract, acting on behalf of a company, a professional activity or as a self-employed person. You are responsible for maintaining the confidentiality of your credentials and for all activity carried out under your account. You undertake to provide truthful and up-to-date information and not to use the Service for unlawful or fraudulent purposes or in ways that infringe the rights of third parties.
5. Zobooq is a tool, not an advisor
Zobooq is a tool to support management and does NOT replace the professional advice of an accountant, tax advisor, lawyer or tourism-regulation expert. You are solely responsible for compliance with the obligations applicable to your activity, including the tourism license or registration number, the registration and reporting of travelers, local accommodation regulations and your tax obligations. The functions of the Service facilitate these tasks, but responsibility for their proper fulfillment is exclusively yours.
6. Third-party integrations
The Service allows you to voluntarily connect third-party services (channels/OTAs, payment gateways and advertising platforms). The use of each integration is also governed by the terms and privacy policy of the corresponding provider, and you are responsible for having authorization to connect those accounts. We are not liable for the availability, accuracy or continuity of third-party services, which may modify, suspend or discontinue their access beyond our control.
7. Acceptable use and reasonable use
You undertake to make lawful and reasonable use of the Service. In particular, the following is prohibited: (i) accessing or attempting to access other customers' data; (ii) reverse engineering, copying, reselling or impersonating the Service; (iii) introducing malicious code or overloading the infrastructure; and (iv) using the Service for unlawful or fraudulent purposes or in ways that infringe the rights of third parties. To ensure stability and a fair allocation of resources, we may apply reasonable usage limits, informing you where appropriate. Non-compliance may result in the limitation or suspension of access.
8. Communications
While you have an active account we will send you operational or transactional communications (confirmations, security notices, significant changes to the Service), which are necessary for the provision of the Service and cannot be declined. Marketing or news communications are only sent if you accept them, and you can unsubscribe from them at any time.
9. Intellectual property
The software, brand, design and contents of the Service are owned by the provider or its licensors. The data you enter remains yours; you grant us only the license necessary to host and process it for the purpose of providing the Service to you.
10. Data protection and data processor
The processing of your personal data is governed by the Privacy Policy. With respect to the personal data of third parties that you enter (guests, contacts or staff), you act as data controller and Zobooq as processor, under the terms of the Data Processing Agreement (DPA), which forms part of these Terms pursuant to Article 28 of the GDPR.
11. No warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including without limitation those of merchantability, fitness for a particular purpose or uninterrupted availability.
12. Limitation of liability
To the maximum extent permitted by law, the provider will not be liable for indirect damages, loss of profit, loss of data or harm arising from the use of or inability to use the Service, nor for penalties, surcharges or interest arising from the breach of your obligations. The provider's total liability towards you for any claim related to the Service is limited to the amounts you have paid for the Service in the twelve (12) months prior to the event giving rise to it. None of the foregoing excludes liability that cannot be limited by law.
13. Force majeure
We will not be liable for the failure to perform or delay in performing our obligations when due to causes beyond our reasonable control (force majeure), such as failures of internet, electricity or third-party service providers, cyberattacks, natural disasters or decisions of the authorities.
14. Suspension and termination
You may cancel your account at any time from your account settings. We may suspend or terminate access to the Service if you breach these terms, if required by law, or if we decide to discontinue the Service, in the latter case endeavoring to give you advance notice so that you can export your data.
15. Assignment
You may not assign these terms or your account to a third party without our prior written consent. We may assign our contractual position in the context of a corporate reorganization, merger or transfer of assets, informing you accordingly.
16. Severability
If any clause of these terms is declared null or unenforceable, the rest will remain fully valid. The affected clause will be interpreted or replaced by another valid one that comes as close as possible to the intended purpose.
17. Applicable law and jurisdiction
These terms are governed by Spanish law. For the resolution of any dispute, and unless applicable consumer regulations provide otherwise, the parties submit to the Courts and Tribunals of the provider's domicile.
18. Changes to the terms
We may amend these terms. We will publish the version in force on this page with its date. Continued use of the Service after an update implies acceptance of the new terms.
